Rules and Regulations
Section A. General
The West Webster Cemetery Association Inc., Webster, NY and all property belonging there to, shall be governed by a Board of Directors that shall regulate the sale and price of lots therein, create Rules and Regulations for the Cemetery deemed proper and consistent with the laws of the State of New York.
All visitors shall be allowed access to the West Webster Cemetery from sun up to sun down, observing the posted rules and regulations which are in effect and the propriety due the cemetery.
The West Webster Cemetery Association Board of Directors may amend these rules and regulations and no such amendments shall become effective until approved by the State of New York Cemetery Board.
Section B. Interments
No interment shall be allowed without permission being first obtained from the West Webster Cemetery Association. At the time of applying for permission, the following information must be provided:
- Name of deceased,
- Age of deceased; including date of birth if known.
- Place of birth of deceased if known.
- Date of death.
- Time and date of interment.
- If not adult; the names of parent(s) or legal guardian(s) of deceased.
Interment and vault storage of remains shall be prohibited in the West Webster Cemetery without the issuance of a Receipt of Body Permit pursuant with Public Health Law, Section 4145 (2) (b).
A Receipt of Body Permit shall be issued only to those persons that can establish a right to interment.
Interment shall be restricted to those entitled to interment therein according to the terms of Section 1512 of the Not-for-Profit Corporation Law. Permission of interment for those not entitled to interment according to said section, must be filed with the West Webster Cemetery Association by the lot(s) owner(s).
Interments per full size lot are restricted to the following:
One (1) casketed remains or;
One (1) casketed remains and up to (3) cremains or;
Four (4) cremains
Interments per cremains lot are restricted to as follows:
Two (2) cremains
Concrete vaults or grave liners shall be required for interments in all lots on or after January 1, 1985 in accordance with the West Webster Cemetery Association Board of Directors.
Interment of cremains shall be permitted only in appropriate rigid receptacles such as concrete, fiberglass, metal or plastic.
Cremains are forbidden to be scattered on West Webster Cemetery Association property.
A lot owner is prohibited from allowing an interment to be made on their lot for compensation.
No funeral shall commence at the cemetery after 3:00 PM to allow sufficient time for the proper closing and removal of equipment no later than 5:00 PM.
The State of New York Cemetery Board directives 201.8 and 201.12 shall govern interment on Sundays and Holidays.
No lot openings shall be considered when frozen ground and/or weather conditions warrant such determination. Remains received for interment during unfavorable conditions shall be placed in the vault until conditions are determined favorable.
All remains retained in the vault due to unfavorable weather conditions shall be removed and interred no later than May 15.
All remains in the vault after June 1 shall be removed and interred. If not entitled to interment in a family plot, they will be interred in a single grave. The expense of interment shall be borne by those who caused the remains to be placed in the vault. Only such notice shall be given in this case as shall be practical under the circumstances.
Disinterment shall be allowed between the hours of 9:00 AM and 3:00 PM providing the provisions of Section 1510(e) of the Not-for-Profit Corporation Law are complied with and at a cost twice the current interment charge.
Section C. Lots
Lots in the West Webster Cemetery shall be sold in accordance with the provisions set forth by laws of the State of New York and shall not be used for any purpose other than interment for human remains.
The West Webster Cemetery must receive full payment for a lot prior to issuance of a deed and/or interment proceedings.
Lot owners shall not transfer a lot except as provided for in Section 1513(c) of the Not-for-Profit Corporation Law.
Lot owners shall notify the West Webster Cemetery of an address change. Notices sent to lot owners by the West Webster Cemetery Association shall be sent to the last recorded address and shall be deemed adequate.
Vaults and mausoleums are prohibited above ground without prior approval from the West Webster Cemetery Association Board of Directors.
Vaults and mausoleums may be considered, providing a sufficient endowment is in place assuring the necessary income required to provide adequate care.
Section D. Monuments
One monument shall be allowed per lot and shall be set in accordance with the general plan of the cemetery conforming to said plan in size and material. Exceptions shall be granted to official United States Government plaques and/or monuments.
Monuments and/or markers shall be constructed in accordance with the regulations set forth by the State of New York.
Monuments and markers are prohibited which utilize colors other than those of natural stone.
Monument bases shall be finished true and level assuring satisfactory fit with the foundation.
Monuments shall not be delivered nor received at the West Webster Cemetery prior to the completion of a foundation approved by the cemetery superintendent.
Foundations for monuments shall be constructed by or under the direction of the West Webster Cemetery Association.
Section E. Decorations
Planting of natural or artificial flowers is allowed on the East (Maple Dr.) side of a monument for the width of the monument and not to exceed eighteen inches (18”) in a semi-circular form.
Glass, metal and/or plastic containers of any description are prohibited for use at the West Webster Cemetery.
Lot owners are prohibited from planting trees, evergreens, shrubs and rose bushes and the West Webster Cemetery Association reserves the right to remove those deemed hazardous to the cemetery employees and/or visitors upon due notice to the lot owner.
Fencing, stones, pebbles and wood chips are prohibited for use at the West Webster Cemetery.
The West Webster Cemetery Association reserves the right to remove any and all decorations, natural or artificial, as soon as they become unsightly and/or hazardous.
Winter holiday decorations shall be removed no later than April 1.
The West Webster Cemetery Association reserves the right to remove, after due notice, any embellishment, effigy or inscription that, in the judgment of a majority of the Board of Directors, is unsightly or hazardous.
Section F. Miscellaneous
Funerals, processions and vehicles shall be under the control of the cemetery superintendent while on West Webster Cemetery property.
Vehicles or vehicular traffic shall be refused entrance to West Webster Cemetery when, in the judgment of the superintendent, damage to cemetery property may result.
The cemetery driveway is a seasonal driveway and not maintained during winter months.
Cemetery personnel shall carry out all work in the West Webster Cemetery under the supervision of the cemetery superintendent and/ or Board of Directors.
Alcoholic beverages and their consumption are prohibited on West Webster Cemetery Association property.
Unlicensed off-road vehicles are forbidden on West Webster Cemetery Association property.
Speeds exceeding five (5) MPH are prohibited on West Webster Cemetery Association property.
The discharge of firearms is prohibited in the West Webster Cemetery with the exception of military type services and/or memorial services.
The West Webster Cemetery is a Carry In-Carry Out cemetery.
Vandals shall be prosecuted to the full extent of the law.
